Rights holders in other countries may use the same procedure.
1. How to Send a Notice
1.1. Where to Send It: Email [email protected] with the subject line "DMCA Notice", or write to Generative Flows AI Sàrl, Copyright Notices, Chemin de Prael 7F, 1030 Bussigny, Switzerland.
1.2. What It Must Contain: Your notice must include:
- Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner
- Identification of the copyrighted work you claim is infringed (or, for several works, a representative list)
- Identification of the material you claim is infringing, with the URL of each page where it appears, so we can find it
- Your name, postal address, telephone number and email address
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf
1.3. Incomplete Notices: We may be unable to act on a notice that is missing any of these elements. We will tell you what is missing when we can.
1.4. False Claims: Knowingly misrepresenting that material is infringing may make you liable for damages, including costs and attorneys' fees.
2. What Happens Next
2.1. Review: We review every complete notice and remove or disable access to the identified material when the notice is valid.
2.2. Notifying the User: Where the material was created or shared by a user, we tell that user it was removed and send them a copy of the notice, which may include your name and contact details.
2.3. Repeat Infringers: We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the rights of others.
3. Counter-Notice
3.1. When to Use It: If material you created or shared was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address, with the subject line "DMCA Counter-Notice".
3.2. What It Must Contain:
- Your physical or electronic signature
- Identification of the material that was removed and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification
- Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Generative Flows AI Sàrl may be found), and that you will accept service of process from the person who sent the original notice or their agent
3.3. Restoring Material: We forward a valid counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to restrain the use, we may restore the material within 10 to 14 business days of receiving the counter-notice.
4. Other Requests
4.1. Likeness and Privacy: To report content that resembles a real person or uses someone's likeness, follow our Content Removal Policy; no copyright claim is needed.
4.2. Content Involving Minors: Report it immediately under our Child Safety Policy.
4.3. Notices from the EU and the UK: Notices about illegal content from users in the European Union are handled under the notice-and-action mechanism of the Digital Services Act (Regulation (EU) 2022/2065, Article 16), and notices from users in the United Kingdom under the Online Safety Act 2023. Send them to the same address, with the exact URL of the content, an explanation of why you believe it is illegal, your name and email address, and a statement that you believe in good faith that the notice is accurate and complete. We confirm receipt, review the notice, tell you what we decided and why, and explain how to contest the decision.
4.4. Trademarks and Other Rights: Send trademark and other intellectual property complaints to the same address. The counter-notice procedure in section 3 applies to copyright only.
